與時代脫節的版權法諮詢

雖然聲稱要 "小心平衡各方不同的權益"，但諮詢文件裡只得有一個有關 caching 的部份提及合理使用的原則，我們的政府真係眼光闊到無人有。

且看 "在數碼環境中保護知識產權" 的官方諮詢文件:

第一章　未獲授權而上載和下載版權作品的法律責任
第二章　為透過各種傳送科技向公眾發放的版權作品提供保護
第三章　互聯網服務供應商在打擊網上盜版問題上扮演的角色
第四章　協助版權擁有人對網上的侵犯版權行為提出民事訴訟
第五章　侵犯版權的法定損害賠償
第六章　為暫時複製版權作品提供版權豁免

然後比較一下人家的 vision:

再聯想到近日叮噹網站被勒令關門的故事和IFPI派員24小時監察全港網誌的搞笑行為，不禁要借用 techdirt 的一句：

"why not try to understand what happens when you have a lack of scarcity and how to profit from it, rather than fighting the obvious trend?"

    e: this is a 既定思維 problem...the industries have a big role to play too (i.e. they should face the problem instead of trying to control what is uncontrollable and which is against the development of technology)
